Performance Agreement

  1. Force Majeure & Cancellation by Artist
    The Artist’s performance is subject to conditions beyond the Artist’s control, including but not limited to government shutdowns, major disasters, power failures, venue emergencies, or other force majeure events. If such circumstances prevent the Artist from performing, all fees and any payments made toward the balance will be refunded to the Client within ten (10) business days, and the Artist will have no further liability. If the Artist cancels or cannot perform for any reason within their control, the Artist will make every reasonable effort to secure a replacement of similar quality at the contract price.

  2. Payment, Termination & Client Cancellation

    • The Client must pay the full balance by the stated due date. Failure to do so will automatically terminate this contract; the Client forfeits the non-refundable retainer and all payments made, and the Artist will have no further responsibility.

    • A $100 reinstatement fee applies if the Client seeks to reinstate a terminated contract.

    • If the Client cancels service for any reason, all payments made are retained by the Artist as liquidated damages.

    • The Artist’s maximum liability for any breach of obligations shall not exceed the total fees stated in this contract.

  3. Entire Agreement & Amendments
    This document contains the entire agreement between the parties. No oral statements, promises, or inducements are valid unless included here. Any modification must be in a written amendment signed by both parties.

  4. Authority to Contract
    Each signatory affirms they are of legal age and authorized to bind their respective party. Anyone signing without such authority personally assumes full responsibility for payment under this agreement.

  5. Client Responsibilities & Guest Conduct
    The Client is responsible for supervising guest behavior. If guest conduct becomes intolerable and remains uncorrected after notice, the Artist may end the performance without refund. The Client is liable for any costs of repair or replacement of equipment damaged or stolen due to audience actions.

  6. Artist Responsibilities & Limitations

    • The Artist provides all required equipment, materials, travel, setup, and breakdown time.

    • The Artist is not responsible for lost performance time caused by venue power loss, fire alarms, or other interruptions outside the Artist’s control.

    • Only properly licensed music will be played; unlicensed music requests will not be honored.

  7. Venue Access & Utilities
    The Client must provide the Artist access to the venue at least ninety (90) minutes before the scheduled start time and ensure a setup area with functioning electrical outlets.

  8. Additional Terms

    • Unscheduled overtime, subject to availability, is billed at $150 per hour.

    • Personal checks are not accepted.

    • Receipt of the non-refundable retainer and an e-signed contract constitutes acceptance of all terms and is binding on all parties.
